What Our Clients Say

Motorcycle Accidents: What You Should Know

Driving a motorcycle isn't like operating any other kind of vehicle. The rush you get as a motorcycle driver is undeniable. Unfortunately, so are the risks that come with driving them. Despite only 3% of road users being motorcyclists, in 2021, there were 3,712 motorcycle accidents in North Carolina. 210 of those accidents were fatal. That means that in one year alone, dozens and dozens of families lost loved ones due to motorcycle crashes. Often, these tragic accidents aren't caused by mistakes the motorcycle rider makes. They're due to another driver's negligence.

In the event of a motorcycle accident, the probability of sustaining significant injuries is considerably higher, as even the most effective motorcycle gear can only offer limited protection. In collisions with other vehicles, we have no protection. Furthermore, the other vehicle involved in the accident will likely be much larger, increasing the chances of injury or even fatality. Although the other driver's insurance may cover some of the expenses for your medical bills and motorcycle repairs, their insurance company will make every effort to minimize the amount they have to pay. Carl Nagle is a former claims adjuster and former insurance company lawyer. He knows how to oppose insurance adjusters and avoid the insurance company's efforts to minimize your injury claims. If you've been injured while riding your motorcycle, you deserve generous compensation – but without the help of a Motorcycle Accident Injury Attorneys, you may only get a fraction of what you need.

Understanding Your Rights as an Injured Motorcycle Driver

If you've been injured in a motorcycle accident in North Carolina, it's important to be aware of your rights. North Carolina statutes and case law establish valuable laws and legal rights to protect you and ensure that you receive fair treatment in the aftermath of the accident. It's essential to understand your rights as an injured motorcyclist and take active measures to safeguard them. One of the best ways to do so is to seek the advice of an experienced Motorcycle Accident Injury Attorneys in New Bern, NC, who can help you navigate the legal process, pursue fair compensation, and achieve the best possible outcome for your case. Whether you choose our firm or another, injured riders should seek one or more free legal consultations to understand their legal rights and options before they start cooperating with insurance adjusters.

Some of the rights you have as a hurt motorcycle rider include:

1. The Right to File a Personal Injury Claim

You have the option to pursue compensation for your injuries by filing a personal injury claim against the responsible party. Because North Carolina uses a fault-based system which requires insurance on all registered motor vehicles, you can also get compensation from the negligent party's insurance company.

Personal Injury Claim

2. The Right to Pursue Compensation

If you've been injured in a motorcycle accident as a result of someone else's negligence, you are entitled to pursue compensation for your damages, injuries, and losses. This can encompass past and future lost wages and lost earning ability, payment for past medical bills and future medical needs, and payment for pain, suffering, disability, scarring and disfigurement and lost quality-of-life.  Insurance adjusters seek to minimize these payments, but we push them to pay a settlement that reflects what we would expect from a jury in your home county.

Pursue Compensation

Working without a lawyer in your motorcycle compensation case is a little bit like trying to conduct your own trial with no training and no lawyer in the ---countywherecitysits------ County Superior Court in New Bern, NC. It's exceedingly difficult. Insurance adjusters are cost control experts, and they are being paid to minimize your injury claims. They will not help you find reasons to pay you more. Instead, they will try to deny the claim entirely by placing partial blame with you. In North Carolina, if you are just 1% at fault for your accident, you have no right to compensation. If you are clearly innocent, the adjuster will still seek to pay you as little as possible. Throughout the claims process, you have the option to enlist the services of a ----New Bern------------ Motorcycle Accident Injury Attorneys who will work to represent your interests and speak on your behalf. With their assistance, you can safeguard your rights, maneuver through intricate legal processes, and  succeed in all negotiations with insurance companies to secure equitable compensation.

You have the option to seek a just resolution that fully compensates you for your injuries and losses. When you work with Nagle & Associates, our team will evaluate the complete scope of your damages and engage in discussions with the insurance company to achieve a fair and equitable settlement.

Fair Settlement

5. The Right to a Trial

If an equitable agreement cannot be achieved through negotiations, you have the option to bring your case to trial. In this scenario, a jury will assess liability and grant damages according to the evidence that is provided.

Right to a Trial

6. The Right to Appeal

Typical Motorcycle Crash Injuries in North Carolina

It doesn't take a graduate from Craven Community College in New Bern, NC to know that talking about roadway crash injuries is an uncomfortable subject. That's especially true when motorcycles are involved, because they're often the most gruesome and fatal.

Here are just a few of the most common types of injuries that motorcycle drivers recover from:

When you are hit in a motorcycle crash and fall off your bike, you often skid on the road surface, causing lacerations, abrasions, and severe skin damage.

Serious head injuries are both common and severe in motorcycle crashes. Wearing a helmet can reduce the risk of damaging your brain or skull, but it's not a foolproof solution. Severe traumatic brain injuries often occur, even when bikers wear full face helmets.

Accidents involving motorcycles often result in internal injuries like harm to organs, internal bleeding, and injuries to the abdomen or chest.

Injuries to your spinal cord can vary in severity, ranging from minor contusions to the spinal cord to severe damage that can result in paralysis or lifelong disabilities.

Motorcycle collisions frequently cause fractures and joint injuries, such as joint dislocations and broken bones in the legs, ribs, arms, and pelvis.

Motorcycle accidents have the potential to cause a range of psychological injuries, including post-traumatic stress disorder (PTSD), which can manifest as intrusive thoughts, nightmares, and hypervigilance. Motorcycle crash victims may also experience heightened anxiety, characterized by feelings of unease, restlessness, and worry.

Though motorcycle drivers must wear helmets in North Carolina, headgear can only do so much for you when you're hit by another motorist. Injuries can vary from small cuts and bruises to serious facial damage, such as dental injuries and harm to the jaw or eyes.

Nagle & Associates Pro Tip

In the immediate aftermath of a motorcycle accident, there are some general rules you should follow. Think before you speak. Don't accept guilt, even if the crash was your fault. Avoid sharing details on social media or discussing your case with anyone except your Motorcycle Accident Injury Attorneys in New Bern, NC, or your doctor. Lastly, refrain from making any statements to the media if they show up at the scene.

Joe Wolf, a former North Carolina captain for Dean Smith who went on to play for seven teams in an 11-year NBA career before becoming a coach, died unexpectedly Thursday, the Milwaukee Bucks announced.

Wolf, an assistant coach for the Wisconsin Herd — the Bucks' G League affiliate — was 59.

“Throughout his life, Joe touched many lives and was a highly respected, adored and dedicated coach and player across the NBA,” the Bucks said in a release announcing Wolf's death. “His well-regarded talent was instrumental for the Bucks and Herd over eight years with the organization, including as a player and coach.”

Wolf was a high school All-American in 1983 before joining the Tar Heels to play alongside the likes of Michael Jordan and Sam Perkins. Wolf was a co-captain for the Tar Heels as a senior in 1986-87, sharing that role with Kenny Smith.

North Carolina went 115-22 in Wolf's four seasons, making the Sweet 16 twice and the Elite Eight twice in that span. Wolf — a 6-foot-11 center and forward — quickly moved into coaching once his NBA career was done, using skills he said Smith began instilling in him from the start of his college experience.

“I like to think I started getting trained the minute I stepped on campus,” Wolf told the Greensboro (N.C.) News and Record in 2018. “Coach Smith was all about building the proper habits. That benefits me today.”

He was an All-ACC pick in 1987 and left North Carolina with 1,231 points. The Los Angeles Clippers used the No. 13 pick in the 1987 draft on Wolf, who spent his first three NBA seasons there before playing for Denver, Charlotte, Orlando, Portland, Boston and Milwaukee — a return to his home state of Wisconsin, where he was a high school legend.

Wolf led Kohler High School to three Wisconsin state championships, and in 2005 the Milwaukee Journal Sentinel named him the state's greatest high school basketball player ever, the Bucks said.

He coached at the college level as an assistant at William & Mary and UNC Wilmington, was a head coach in what is now called the G League with Idaho, Colorado and Greensboro, had been an NBA assistant for Milwaukee and Brooklyn and was hired in 2023 as a G League assistant for the Herd.

“It’s our turn to help our neighbors”

NEW BERN, N.C. (WITN) - Packed boxes and vehicles have been arriving at the Number 7 Township Fire and Rescue Department in New Bern to donate essential supplies for those affected by Hurricane Helene, which caused widespread devastation in the Western North Carolina region.

Nancy Williams, the President of the Women’s Auxiliary of the Number 7 Township Fire Department, says it warms her heart to see the overwhelming amount of support and willingness to give back to those who assisted the community back East when it was struck by devastating storms.

“We started yesterday and we ended up with beyond what my poor little brain can even imagine. I mean I was blown away by the response. There were Probably 50 to 60 people who showed up to donate,” says Williams.

Township 7 Fire Chief Mike Paul and others within the department have been deployed to Western NC to assist with search and rescue and clearing roads for the next 7 to 10 days, says Williams.

The conditions in Western North Carolina are devastating and seem like a terrible dream, according to Boone residents. They are overwhelmed by the amount of support they are receiving not just from Eastern North Carolina, but across the country.

One Appalachian State professor and her husband, who used to live in Greenville, say that the conditions in Boone are nothing like what they’ve seen in the East due to the road infrastructure and the terrain.

“Well here, because of the erosion, the water undercuts the roads and they wash out. If the road is on a slope or incline, it completely washes downhill so there are no roads in many cases...they’re just completely gone,” says Barrett Gardner.

One Appalachian State student who was stranded in his home said the conditions driving down the mountain after being rescued by his friend were like a mini Apocalypse.

“I remember getting back home and was almost in shock from everything that I’ve seen from the flooding, the damages, no gas, and downed trees...Like I’ve never thought I’d see a house in shambles floating along a river,” says Appalachian State student Liam Able.

Williams stated that they are currently not accepting food-related items or canned food, but they are open to receiving toiletries, pet food, and cleaning supplies.

Number 7 Township Fire Department donation drop-off times are Monday-Thursday from 11:30 am to 2:30 pm and 5:00 pm to 7:00 pm, as well as Sunday from 11:30 am to 3:00 pm.

For a 5 kW installation, this comes out to about $12,274 before incentives, though prices range from $10,433 to $14,115. As of October 2024, the average solar panel system costs $2.45/W including installation in New Bern, NC. For a 5 kW installation, this comes out to about $12,274 before incentives, though prices range from $10,433 to $14,115. After the federal tax credit, the average price drops by 30%.

You'll probably pay even less than what we show here. It doesn't include the federal ITC or New Bern, NC state incentives, which will lower this price by at least a few thousand dollars.

It may seem obvious but larger solar panel systems cost more money. We use cost per watt ($/W) so you can easily compare quotes, controlling for slight variations in system size.

While a 5 kW system will only cost you $12,274 in New Bern, NC, doubling the system size effectively doubles the price, so you'll pay about twice that for a 10 kW system. The higher the price tag, though, the more you'll get back as a credit towards your federal tax bill.

Average solar cost by system size in New Bern, NC

If you can't shell out $12,274 in cash to pay for solar, don't sweat it. You can choose to finance your system with a loan instead. Some companies even offer $0-down loans so you can start saving on day one if your loan payments are less than your current electric bills. Just keep in mind that your long-term savings will be lower with a loan due to interest rates.

The numbers we're showing are averages. The price you'll pay for solar depends on many factors unique to you and your home:

If you're looking for solar companies in NC, here are some popular suggestions:

Solar is a major purchase, but you can get the price tag to come down a bit by being an educated shopper. Taking advantage of incentives and rebates and shopping around for quotes can bring down your cost of solar in New Bern, NC.

As long as your federal tax bill is high enough, you can take advantage of the federal tax credit in New Bern, NC. This incentive allows you to apply 30% of your solar installation and equipment costs toward your federal tax bill. If the amount exceeds your tax bill, you can roll over the remaining credit to the following year. Many states also offer great local incentives and rebates.

Comparing multiple solar quotes can save you money through competition and transparency. Each additional quote you receive for solar will help you find the right solar panel system at the right price.

This is where EnergySage can help. What’s at stake?

PIttsburgh is chasing its first 5-0 start since 1991 as it opens ACC play, as well as its first win in eight tries in Chapel Hill. North Carolina is trying to regroup after two weeks that have shaken the program, first in a 70-50 home loss to James Madison of the Sun Belt Conference and then blowing a 20-point lead in a 21-20 loss at rival Duke.

Key matchup

Pitt's offense against UNC's reeling defense. The Panthers have thrived under new coordinator Kade Bell, who was previously at Western Carolina. They're averaging 48.5 points per game, fifth-most in Bowl Subdivision ranks. They're facing a UNC defense that had gotten off to a solid start under first-year coordinator Geoff Collins — the former Temple and Georgia Tech head coach — before the JMU and Duke losses. The Blue Devils had 297 yards after halftime in their comeback and averaged 6.4 yards per rush after managing just 2.1 in the first half.

Players to watch

Pittsburgh: RB Desmond Reid. The Western Carolina transfer has been a revelation since following Bell to Pitt. Reid sat out a blowout victory over Youngstown State but is averaging an ACC-best 188.0 yards from scrimmage. The 5-foot-8, 175-pound Reid is also averaging a healthy 8.5 yards per touch.

UNC: RB Omarion Hampton. He is the engine of UNC's offense, ranking fifth in the Bowl Subdivision ranks by averaging 131.6 yards on the ground. The preseason Associated Press All-American is tied for 16th in FBS with six rushing touchdowns.
